Terms of Service

Welcome to YesToken ("YesToken", "we", "us" or "our"). These Terms of Service (together with our Privacy Policy, the "Terms") form a legally binding contract between you and YesTokenregarding your use of our website and AI model gateway service (collectively, the "Service").
BY REGISTERING AN ACCOUNT OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you do not agree to the Terms, you do not have our permission to use the Service.
1. Service Overview
YesTokenoperates an API gateway that allows users to access third-party generative AI models (including text, image, audio, and video models) through unified, OpenAI-compatible and provider-native APIs ("Models"). We may add, remove, or change Models, channels, and pricing at any time.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent and warrant that: (a) you are at least 18 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use comply with all applicable laws. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts and API Credentials
3.1 Account Registration
To access most features you must register an account with accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately if you believe your account is no longer secure.
3.2 API Keys
You are responsible for the confidentiality and security of all API keys issued to you. API keys are shown in full only once at creation; we store only hashes. Any request made with your API key is deemed to be made by you and is billable to your account. Revoke compromised keys immediately in the dashboard.
4. Payment and Billing
4.1 Prepaid Balance
The Service is primarily prepaid: you recharge your balance and usage is deducted based on the model pricing, applicable context-length tiers, service-tier multipliers, and any group multiplier applied to your API key, as published on the Models page at the time of use. Payments are processed by Stripe; we do not store full card numbers.
4.2 Usage Measurement
Charges are calculated from the usage reported by the upstream provider (or, where unavailable, from platform estimates, which are marked as such). For video generation, a pre-authorization hold is applied at task creation and settled to the actual usage when the task completes; failed tasks are refunded. Minimum recharge amounts may apply.
4.3 Refunds and Expiration
Except as required by law, recharges are non-refundable and balances do not expire while your account remains active. If your balance is insufficient, requests will be rejected until you recharge.
4.4 Pricing Changes
Model pricing may change when upstream providers change their pricing. Updated prices take effect when published on the Models page; continued use after publication constitutes acceptance.
5. Model Terms and Upstream Providers
Each Model is subject to the terms and usage policies of its upstream provider ("Model Terms"), which flow down to you. You agree to comply with the applicable Model Terms. Providers may suspend or withdraw Models; we may suspend access to any Model accordingly. Where a Model requires identity verification (KYC) or restricts real-person imagery, you must complete verification and comply with those restrictions before using the feature.
6. User Content
6.1 Your Content
You retain all rights to the prompts, files, images, audio, and video you submit ("Inputs") and, subject to the applicable Model Terms, the generated outputs ("Outputs"). You grant us a limited license to transmit, process, and temporarily cache your Inputs solely to provide the Service.
6.2 No Training on Your Data
We do not use your Inputs or Outputs to train models, and we do not store request or response bodies in our logs. Note that upstream providers may have their own data practices; see our Privacy Policy for details.
6.3 Your Responsibilities
You represent and warrant that you have all rights, consents, and permissions necessary for your Inputs (including consent from any identifiable person whose likeness or voice appears in them) and that your use of the Service does not violate any law or third-party right. AI-generated Outputs may be inaccurate or non-unique; you are responsible for evaluating them before use.
7. Prohibited Conduct
You may not use the Service to:
- Violate any law, regulation, or third-party right (including intellectual property and privacy rights).
- Generate illegal, harmful, deceptive, or exploitative content, including CSAM, non-consensual intimate imagery, or content intended to defraud.
- Circumvent identity verification, rate limits, billing, or safety filters, or probe and attack the Service or upstream providers.
- Resell or sublicense access to the Service without our written consent, or share your account or API keys with unauthorized parties.
- Misrepresent AI-generated content as human-created where prohibited by law or Model Terms.
- Interfere with other users or the integrity of the Service.
We may suspend or terminate accounts, revoke API keys, and report unlawful activity where we reasonably believe this section has been violated.
8. Service Availability and Changes
We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. Because the Service depends on upstream providers, Model availability, latency, and behavior may change without our control.
9. Termination
You may stop using the Service at any time and request account deletion as described in the Privacy Policy. We may suspend or terminate your access for breach of these Terms, non-payment, fraud, or legal risk. Provisions that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) survive termination.
10. Intellectual Property
The Service, including its software, design, and documentation (excluding your User Content and third-party Models), is owned by YesToken and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
11. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, LAWFUL, OR SUITABLE FOR YOUR PURPOSE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YESTOKEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless YesToken from claims, damages, and expenses arising out of your Inputs, your use of Outputs, your violation of these Terms or applicable Model Terms, or your violation of any law or third-party right.
14. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which YesToken is incorporated, without regard to conflict-of-law principles. The parties will first attempt to resolve disputes informally; failing that, disputes will be resolved in the competent courts of that jurisdiction, except where applicable law provides otherwise.
15. Changes to These Terms
We may revise these Terms from time to time. Material changes will be posted on this page with an updated date and, where appropriate, notified to registered users by email. Continued use of the Service after changes take effect constitutes acceptance.
